The High Court handling electoral matters has dismissed an application filed by Faridah Nambi’s legal team, in which they sought to have three witnesses for Member of Parliament Elias Nalukoola struck out in the petition challenging his victory as Kawempe North MP.
Nambi’s lawyers argued that the three witnesses lacked credible and admissible evidence. They claimed the witnesses were merely tarnishing Nambi’s name without presenting concrete or photographic evidence to support their statements, rendering their testimonies baseless.
However, presiding judge Jane Okuo Kajuga rejected the application, stating that the matters raised could not be resolved through a preliminary application. Instead, she ruled that such concerns should be addressed during the full hearing of the petition when all evidence is examined. She emphasized the importance of fair trial procedures over hastily excluding witnesses without due process.
The ruling comes as a boost to Elias Nalukoola, who won the Kawempe North parliamentary seat. Nambi, who lost the race, petitioned court challenging Nalukoola’s victory, citing irregularities including vote rigging, intimidation, and ballot stuffing.
With Nambi’s application dismissed, all witnesses lined up by Nalukoola will now be allowed to testify in court, strengthening his defense.
Justice Kajuga further directed that the hearing of the main petition proceeds on May 20, 2025. The court’s decision to dismiss the application has left the electorate in Kawempe North watching closely, as the case will ultimately determine the legitimacy of Nalukoola’s tenure as MP.
